The grey area, which I agree is a phony one, exists on the issue of "choice." For whatever reason, if a woman *chooses* to abort her unborn (because it's her body or whatever), then it's okay. But because the unborn child was killed without her consent, it's not okay.

It makes little to no sense to me, but that's how the pro-abortion crowd is describing this case.

Also of note: it varies from state-to-state. It is state law in California that killing an unborn child, and not in the "form" of an abortion, is a homicide. This is not true throughout the nation.
