You're both probably onto something, but it's Murphy's Law, not anything inherent in Murkon's Refuge. All of the rarest of each equipment type have an equal rarity. That said, some classes have more commonly available special items than others, but this doesn't change based on who you're playing.

The exception to the "equal rarity" is, indeed, the non-equippable items. There are more of them, so the rarest of these, Rod of Catastrophe, occurs less frequently than the rarest item of every other equipment type.
