Except that, by writing with the pen, the customer commits the same crime as by writing on the notepad. Neither belongs to him and therefore he has no right to use either before he's purchased it. Any opening of packages, testing out of product, etc., without the express permission of the management is defacing of private property, and it's illegal.
Problem is, everyone's so concerned with "making the customer happy" and "the customer is always right" that they get walked right over, and customers start to think they can get away with whatever they want.
