From the website you linked to: "The main objective of the Alien Registration Act was to undermine the American Communist Party and other left-wing political groups in the United States."

Undermining one thing and making it illegal are two different things. It is legal to run for public office on a communist platform.

Regarding the Alien Registration Act and the American Communist Party, http://www.spartacus.schoolnet.co.uk/USAcommunist.htm reads in part: "It was difficult for the prosecution to prove that the twelve men had broken the Alien Registration Act, as none of the defendants had ever openly called for violence or had been involved in accumulating weapons for a proposed revolution."
