GOA didn't get very far

I understand in order to get the picture from inside the castle I need to cause a commotion outside the castle. Here's some problems I am running into. I couldn't get the hammer, I tried "waiting" around and he always got me. I left the crate in the bottom of the shack and now it won't let me jump back down there and get it.
I tried tying the rope where it smelled pleasant to use for my descent, but the guard always catches me too.. "waiting around" didn't work in that scenario. Any help would be much appreciated.
