Almost positive. Smith shows up the following times:

1) In the opening scene, giving his earpiece to Neo.
2) When he takes over Bane.
3) In the courtyard after Neo meets the Oracle.
4) When he shows up in the corridor at the end of the film.

At none of those times does he seem to be protecting the Merovingian.

(And the only time Smith shows up in the videogame, which has a lot more to with the Merovingian, is in the corridor while he's waiting for Neo.)
