From the FDA website (now *there's* a fun read):
The FD&C [Food Drug & Cosmetic]Act defines drugs by their intended use, as "(A) articles intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease..and (B) articles (other than food) intended to affect the structure or any function of the body of man or other animals" [FD&C Act, sec. 201(g)(1)].
Which doesn't really cover recreational drugs, does it, since the intended use is not disease-related. So, medicine = non-food, recreational drugs = food?
