Who owns the land? Are they liable for any mishaps? Public land ownership never seems to work very well, because matters of use get political and responsibility doesn't fall on the right people. Also, without free publicly-provided disposal of toxic wastes, probably not many people would be willing to bear the costs of a business which creates the stuff; even green energy might be cheaper than nuclear plants if the latter received no subsidies.

Practically, though, since we've already got the waste, it's got to go somewhere. Yucca Mountain is considered a safe storage facility.
